Terms of Service

By using Hugo, you agree to these terms. Please read them carefully.

1. What Hugo is

Hugo is an AI-powered personal assistant that acts on your behalf inside WhatsApp, Telegram, and — over time — native iOS, Android and Meta Glasses apps. Hugo manages calendars, sends mail, places bookings, sets reminders, places phone calls and more. Hugo is operated by [Company Name BV], KvK [number].

2. Account and use

You must be 18 years or older to use Hugo.
You use Hugo for personal or business purposes — not for illegal activities or spam.
You are responsible for access to your WhatsApp / Telegram / app accounts.
We may suspend your account without prior notice in case of fraud or abuse.

3. Subscription and pricing

Prices include VAT. Subscriptions renew monthly until you cancel. Booking costs (flights, hotels) are separate and charged to your stored credit card by Duffel.

4. Bookings via Hugo

Hugo places bookings only after explicit confirmation from you (a "yes" or a button tap in chat).

We act as your agent at Duffel; the actual booking is between you and the airline / hotel / supplier.
Spend caps are hard: a booking above your monthly limit is refused. Upgrade or wait for next month.
Refunds, changes and cancellations follow the supplier's rules. Hugo helps you arrange them but cannot guarantee refundability.
We are not liable for:
- Delays or cancellations by airlines / hotels
- Incorrect bookings you confirmed without reviewing the summary
- Exchange-rate losses
- API outages at our suppliers

5. AI limitations

Hugo uses large language models. They can make mistakes. You are responsible for verifying:

Amounts, dates, times and destinations before confirming
The content of emails Hugo drafts before tapping send
Calendar changes that may be irreversible

We do our best to make Hugo accurate and helpful, but provide no warranty on correctness.

6. Privacy

See our separate privacy policy. Short version: we store as little as possible, audio is removed after 24 hours, and you can wipe everything with /data delete.

7. Termination

You can cancel at any time via /cancel in chat or your Stripe portal. Access continues until the end of the current billing period.
We may suspend or terminate your account for breaches of these terms or legal obligations.

8. Liability

Our total liability towards you is capped at the amount you paid for Hugo in the last 12 months, with a minimum of €100.

We exclude liability for:

Indirect damages, lost profits, consequential damages
Damages from unavailability of upstream APIs
Damages from incorrect input by you (e.g., wrong date confirmed)

Nothing in these terms limits our liability for intent, gross negligence, or our obligations under mandatory law.

9. Changes

We may update these terms. Material changes are announced 30 days in advance. By continuing to use Hugo after a change, you accept the new version.

10. Governing law

These terms are governed by Dutch law. Disputes are submitted to the competent court in Amsterdam.
